Subsisting cause of action survives death. 2(1)Except as provided in subsection (2), where a person dies,all causes of action subsisting against or vested in him survive against or,as the case may be, for the benefit of his estate. SURVIVAL OF ACTIONS ACT. In this Act. Definitions (a) “cause of action” includes a civil proceeding instituted before death, but does not include a prosecution for contravening a statute or bylaw; cause of action (b) “claim” means a claim for damages or equitable relief; claim (c) “court” means the Supreme Court of Prince Edward Island.

Survival of actions 2 Subject to this Act, on the death of any person after 29 December all causes of action subsisting against or vested in him shall survive against, or, as the case may be, for the benefit of his estate: Provided that— (a) this section shall not apply to causes of action.
